6. User-Generated Content

6.1 Your Content

Our Services may allow you to create, post, share, or store content, including but not limited to text, images, videos, usernames, avatars, and gameplay recordings ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content.

6.2 License to User Content

By submitting User Content to our Services, you grant MegaGiga Games a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, modify, adapt, publicly perform, publicly display, and create derivative works from your User Content in connection with operating and providing the Services.

6.3 Content Responsibility

You are solely responsible for your User Content and the consequences of posting or sharing it. You represent and warrant that:

• You own or have the necessary rights to submit your User Content
• Your User Content does not violate the privacy rights, publicity rights, intellectual property rights, or any other rights of any person or entity
• Your User Content does not violate these Terms or any applicable laws

7. In-Game Purchases and Virtual Items

7.1 Virtual Currency and Items

Our Services may offer virtual currency, virtual items, or other virtual goods and services (collectively, "Virtual Items") for purchase with real money. Virtual Items are licensed, not sold, to you and have no monetary value.

7.2 Payment Terms

• All purchases are final and non-refundable, except as required by applicable law

7.3 Virtual Items Restrictions

Virtual Items:

8. Subscriptions and Auto-Renewal

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MEGAGIGA GAMES, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above exclusions and limitations may not apply to you.

You agree to indemnify, defend, and hold harmless MegaGiga Games, its affiliates, and their respective directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of or inability to use the Services
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content

14.3 Effects of Termination

Upon termination:

• Your right to use the Services will immediately cease
• Your account and associated data may be deleted
• You will forfeit all Virtual Items and benefits
• Sections of these Terms that by their nature should survive termination will survive

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MegaGiga Games is established, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@megagiga.games. We will attempt to resolve the dispute informally by contacting you through email.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features of our Services, constitute the entire agreement between you and MegaGiga Games regarding the Services.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

16.4 Assignment
